Partner security
Frame what a surviving partner needs to live, decide and remain secure without obscuring the eventual family outcome.
A will is not simply a document to have. It is a route for partner security, children, control and the family intentions that should remain visible after a death.

Explore whether equal treatment means the same route for every child, especially where roles or needs differ.
Identify where an executor, a staged transfer or clearer instructions may make the transition workable.

Use this original conversation checklist to distinguish a known document from a family route that still works when relationship, ownership, business or country facts have changed.
Is there a known, current will — or a clear reason why there is not — after the latest family, relationship, business or residence change?
Have partner protection, children, stepchildren, minor children or later-generation interests been discussed rather than assumed?
Are marriage, partnership or cohabitation arrangements considered alongside the intended family outcome?
Is a person identified to coordinate the first practical steps, and is the role they would need to play understood at a high level?
Do beneficiary designations, ownership arrangements, business documents and any foreign-asset route support the same intention?

A family may believe that a will has settled everything because it names the heirs. In practice, the difficult questions begin one step earlier: who needs a home and income, who will handle the first weeks, what happens to the company, and whether the bank, notary and family can follow the same route. A useful will is one part of that wider continuity plan.
When a spouse and children inherit together under Dutch law, the statutory distribution (wettelijke verdeling) generally places the estate assets with the surviving spouse and gives the children monetary claims against that spouse. This often protects the survivor’s daily life, but it may not fit an unmarried couple, a blended family, a vulnerable child or a family business. The family can judge a proposed will only after this legal starting point is clear.
If a partner needs continued use of a home or income from assets, a right of use and income, known as usufruct, may be considered. If assets should pass first to one person and later to another, a successive-interest clause (tweetrapsmaking) may be relevant. If a beneficiary needs help managing inherited assets, protective administration (bewind) can appoint an administrator. These tools solve different problems and should not be presented as interchangeable clauses.
A will can appoint an executor: the person authorised to manage estate assets and carry out defined tasks. Naming someone is only the first step. That person still needs the correct documents and a route accepted by the bank, the notary, foreign institutions and, where relevant, a Dutch private limited company (besloten vennootschap, or BV). The procedure should be understood before the event, not discovered during it.

The exact scope, tax analysis and required specialist input depend on the facts. No legal, notarial or tax result is promised before the relevant review.
